These terms and conditions outline the rules and regulations for the use of Alice Nguyen’s website, located at alicenguyenart.com and the services provided by Alice Nguyen. For the purpose of these terms and conditions, “I”, “we”, “Us, “Our”, “Alice Nguyen Art”, and “Alice Nguyen” refers to alicenguyenart.com and “You” and “Your” refers to you, the client, visitor, website user or person using our website. By accessing this website we assume you accept these terms and conditions. Do not continue to use our site if you do not agree with any of the terms, please refrain from using this website.

AMENDMENT OF TERMS

We reserve the right to modify or update these terms at any time without prior notice. Please check these terms prior to using our website to ensure you are aware of any changes. 

LIMITATION OF LIABILITY

We are not legally responsible for any indirect, incidental, or consequential loss or damage you might suffer related to your use of this website or the purchase of any products. 

ACCURACY OF CONTENT

All artworks, including original paintings and prints, are described as accurately as possible. While every effort has been made to show as accurately as possible the colours of the artwork that appear on our website, we cannot guarantee that your computer monitor’s display of any colour will be accurate. 

PRICING AND PAYMENT

All prices are listed in AUD (Australian Dollars) and include applicable taxes. Prices are subject to change at any time. Payment is accepted through Paypal or Stripe. Payment of the invoice in full must be received prior to delivery.

ORDER ACCEPTANCE

Your order will be considered accepted once payment has been successfully processed in the full amount. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or availability of items.

SHIPPING AND DELIVERY OF GOODS

Physical goods may be delivered by Australia Post and/or other reputable courier companies. Shipping costs will be calculate at checkout and vary depending on the destination and size of the item. Deliveries are processed promptly upon receipt of full payment. 

We will attempt to have your artwork sent by the artist within five (5) business days; and delivered within fourteen (14) business days for domestic delivery and thirty (30) business days for international delivery, depending on the delivery option. Please allow longer for artworks coming to remote areas, or if you have chose to have the work framed. We do not accept PO Box or Parcel Locker delivery addresses.

For international orders, buyers are responsible for any customs fees, import duties, or taxes that may apply. We are not responsible for delays caused by customs, postal services, or other factors beyond our control.

After ordering online, you will receive an email confirmation containing your order details, to the email address you have entered. 

We are not responsible for goods that are damaged in transit or have not been received. 

Damaged or lost orders should be resolved with Australia Post or the other reputable courier company directly. Replacement of damaged or lost items is made at the discretion of Alice.

We are not responsible for lost shipment due to incorrect shipping information provided by you. Please double-check your delivery address during checkout.

RETURNS AND REFUNDS

We handle our returns and process refunds under the Australian Consumer Protection Legislation. 

Certain products or services may be available exclusively online through our website. These products or services may have limited quantities and due to the nature of purchases, all sales are final. We do not accept returns or exchanges for changes of mind, if you decide you don’t like the purchase or have no use for it. 

Please notify us within seven (7) days of receiving the work if you wish to return it with a valid reason. Simply contact us via the Contact Page here with your order number, details of the issue and relevant photos if required, and we’ll do our best to make things right. If refund is requested and approved of, you will need to re-package the work in the original packaging it came in and apply the label we have sent to you in the box and send it back to us. Refunds will be issued promptly, using the same payment method you used at checkout. Please note that all refunds are at the discretion of Alice.

Please note that buyers are responsible for return shipping costs. 

COPYRIGHT, TRADEMARKS AND RESTRICTIONS OF USE

Our website contains material which is owned by or licensed to us. All copyright is retained by the artist, Alice Nguyen. The trademarks and logos contained on our website are trademarks of Alice Nguyen.

Except as provided in these terms of use, you are prohibited to use, copy, reproduce and/or redistribute or commercially exploit part or all of the contents on our site in any form, unless prior written consent is obtained from us. You may contact us here if you wish to seek such consent. We reserve the right to take action against you, if you breach any of these terms.

CONFIDENTIALITY AND THIRD PARTY RESOURCES

All personal information you give to us will be dealt in a confidential manner in accordance with our Privacy Policy. 

DISCLOSURE OF INFORMATION

In certain circumstances, we may need to disclose information if required by law or a court. This might also happen if we need to enforce our terms and agreements or protect the rights, property, or safety of our customers or third parties. 

GOVERNING LAW

These terms and conditions and this website are subject to the laws of New South Wales and Australia. Any disputes related to these terms will be subject to the exclusive jurisdictions of the courts in New South Wales.

WHOLE AGREEMENT

These terms and conditions represent this agreement between you and our website regarding your use of this website and the information on it. No other terms apply unless required by any legislation of any State or Territory or by Australian law. Any other implied terms are excluded, except those that can’t legally be left out.
